General Terms and Conditions

1. Registration, conclusion of contract and follow-up courses

Registration for the courses or individual lessons/specials is done electronically via the registration form on the website www.gravityarts.ch.

The minimum age for pole dance courses or individual lessons/specials is 16 years.

By registering electronically, the participant acknowledges the General Terms and Conditions and the contract between the participant and Gravity Arts GmbH (“Gravity Arts”) is concluded.

Registrations will be considered in the order in which they are received. Upon successful registration, a confirmation will be sent automatically by e-mail.

Once a participant has registered for a course for the first time, he or she will automatically be registered for the subsequent course or course subscription (“course”).

2. Fees

The fees at the time of registration for the course subscription or the individual lesson/special apply.

3. Terms of payment / Default of payment

The fees can be paid via Paypal, Twint or by invoice. Individual lessons/specials can also be paid in cash on site.

If you choose to pay by invoice, the payment period is 10 days from the date of invoice. For registrations for individual lessons/specials made less than 10 days before the start of the lesson, the payment period ends before the start of the lesson (expiry date).

Gravity Arts reserves the right to exclude the participant from the course or the individual lesson/special in case of late payment. In case of late payment, reminder fees (1st reminder CHF 10, 2nd reminder CHF 20) will be charged.

4. Cancellation or postponement

Changes in the course plan are possible at any time. Courses or course lessons and individual lessons/specials can be cancelled or postponed by Gravity Arts without giving reasons. Cancellations or postponements will be communicated to the participant in good time, whenever possible.

4.1 Cancellation

In case of cancellation the fee will be refunded.

4.2 Postponement

If the whole course is postponed, the right of withdrawal according to section 5.1 applies. If an individual course lesson or individual lessons/specials are postponed, the right of withdrawal according to section 5.2 applies. If there is no withdrawal, the participant agrees that the course or the course lesson/single lesson/special will take place on the postponement date.

5. Withdrawal of the participant

The withdrawal of the participant from the course or an individual lesson must be made in writing or by e-mail. Non-appearance or non-payment of the fee does not constitute withdrawal. Only partial participation in the course does not entitle the participant to a reduction in payment.

5.1 Cancellation for courses

Cancellation by the participant up to 7 days before the start of the course is free of charge. If the cancellation is made less than 7 days before the start of the course, a contribution towards expenses of CHF 100 will be charged. In the case of withdrawal from the day the course begins, the entire fee (compensation for cancellation at an inopportune moment) must be paid. This regulation applies regardless of the reason for the withdrawal.

5.2 Cancellation for individual lessons/specials

Cancellation by the participant up to 24 hours before the start of the lesson is free of charge. In case of a later withdrawal the entire fee (compensation for cancellation at an inappropriate time) must be paid.

6. Prevention of the participant

6.1 Prevention at courses

If the participant is prevented from attending due to illness or other important reasons, up to three absences of the participant from courses can be made up free of charge in other courses within the same or following course period, after consultation with Gravity Arts, as long as these are not fully booked. The allocation of alternate dates may be subject to the presentation of a medical certificate or other certification. Definitely assigned and agreed substitute appointments cannot be postponed or made up for. Substitute dates that are not taken up will expire without replacement, regardless of the reason.

6.2 Prevention for individual lessons/specials

Individual lessons/specials cannot be made up for. If the participant is prevented from attending, a refund is excluded. In all other respects the right of withdrawal applies.

7. Copyright

All choreographies learned in the course are subject to copyright, which the participant may not violate. In particular, individual movements and choreographies learned in the course may not be performed or taught to third parties, either for payment or free of charge, without the consent of the author.

8. Exclusion of liability / insurance

Participation in the courses and individual lessons/specials is at your own risk. No liability is assumed for injuries and accidents etc. or liability is excluded to the extent permitted by law. Liability for auxiliary persons is excluded. Insurance is the responsibility of the participants. Gravity Arts recommends private liability and accident insurance. Any illnesses, injuries and complaints must be reported to the trainer before the start of the course or the individual lesson/special. Gravity Arts is not liable for theft or loss of personal belongings.
